Terms of Use

Read this first. Pakmandidos is an aid to navigation, not a substitute for your own judgement. Trails change, maps are wrong sometimes, and rider reports may be stale, mistaken or missing entirely. Ride to what you can see, not to what the screen says. Never operate the phone while the vehicle is moving.
1. Agreement
These Terms govern your use of the Pakmandidos iOS app ("the App") and this website. By installing or using the App you accept them. If you do not accept them, do not use the App.
2. What the App is
The App follows a GPX track you supply. It draws the track on a map, gives spoken cues, caches maps for offline use, lets riders report hazards to one another, and keeps a log of your rides.
3. What the App is not
- It is not a route planner. You plan elsewhere; the App follows.
- It does not continuously reroute you.
- It is not an emergency or rescue service. It cannot summon help, and it must not be relied on for that.
- It is not a substitute for paper maps, a compass, a personal locator beacon, or telling somebody where you are going.
4. Safety and your responsibility
Riding and driving off-road carries real risk of injury and death. You alone are responsible for your safety, your passengers, your vehicle, and for obeying the law wherever you ride.
- Do not interact with the phone while moving. The App is designed to be listened to, not watched.
- Obey all traffic laws and posted speed limits. Speed limits shown in the App come from OpenStreetMap, may be missing, and may be wrong. The limit on the sign always wins.
- Respect access rights. A track existing in a GPX file does not mean you are permitted to ride it. Private land, seasonal closures and local restrictions are your responsibility to check.
- Hazard reports are user-generated and unverified. They may be inaccurate, out of date, malicious, or absent where a real hazard exists. The absence of a report means nothing.
- Maps and matched routes may be inaccurate. The track you loaded may not follow a real, passable, or legal path.
- Offline maps cover a corridor around your route. Leave it and the map may be incomplete or unavailable.
- Batteries fail and phones break. Carry a backup means of navigation on any serious route.
5. Scoring
Points are awarded for following your track and for reporting hazards. No points are awarded for speed, and none are deducted for it. Nothing in the App is intended to encourage riding faster than is safe or lawful.
6. Content you submit
You keep ownership of the hazard reports and notes you submit. By submitting them you grant us a worldwide, royalty-free licence to store, display and distribute them to other riders for the purpose of operating the App.
You agree not to submit anything false, misleading, unlawful, defamatory, offensive, or that identifies another person without their consent. We may remove any content, or block a user, at our discretion.
7. Your OpenAI key and third-party costs
Some features — spoken waypoint write-ups, natural voice, and collection card artwork — require you to supply your own OpenAI API key. If you do:
- You are responsible for that key, for your OpenAI account, and for all charges incurred. We do not receive your key and do not bill you.
- Your use of OpenAI is governed by OpenAI's own terms and privacy policy.
- Cost estimates shown in the App are indicative only, and may change without notice.
The App also relies on OpenStreetMap-derived map data and routing services. Map data © OpenStreetMap contributors, licensed under the Open Database License (ODbL).
8. Availability
The App is provided as-is. Core navigation is designed to work offline, but the shared features — hazard reports, leaderboards and crew presence — depend on third-party services that may be unavailable, delayed or discontinued. We may change or discontinue any feature at any time.
9. Disclaimer of warranties
To the fullest extent permitted by law, the App is provided without warranties of any kind, express or implied, including fitness for a particular purpose, accuracy, or uninterrupted availability. We do not warrant that any track, map, speed limit, waypoint description or hazard report is accurate, current, complete, passable or legal.
10. Limitation of liability
To the fullest extent permitted by law, we are not liable for any indirect or consequential loss, or for personal injury, death, property damage, loss of data or loss of profit arising from your use of the App — except where such liability cannot be excluded by law, including liability for intent, gross negligence, or under the German Product Liability Act. Nothing in these Terms limits your statutory rights as a consumer.
11. Age
You must be at least 16 years old to use the App, and legally entitled to operate any vehicle you ride.
12. Termination
You may stop using the App at any time by deleting it. We may suspend access to the shared features if you breach these Terms.
13. Changes
We may update these Terms. The date at the top shows when they last changed, and continued use after a change means you accept it.
14. Governing law
These Terms are governed by German law, excluding its conflict-of-law rules. Mandatory consumer-protection law in your country of residence continues to apply.
